Dippolito Trial

After guilty verdict, here’s what lies ahead in Dippolito case

The case made international news.

Now one of our area's most sensational trials ever is over, with jurors finding Dalia Dippolito guilty of hiring an undercover officer to kill her husband.

But the legal maneuvering is far from over.

Dippolito's attorneys said as soon as the trial was over they planned to appeal. They said there are numerous issues which could be used to challenge the verdict.

"All these prior alleged bad acts that the state used to assassinate Dalia Dippolito's character," said Dippolito attorney Brian Claypool on Friday, shortly after the conclusion of the trial.

Specifically Dippolito's attorneys said they understood there would be no mention of Dalia's prior alleged poisoning of Mike Dippolito with anti-freeze.

But that information came out during a defense witness, as prosecutors attempted to rebut a line of defense questioning.

"The court still has to be careful," said veteran West Palm Beach criminal defense attorney Gregg Lerman.

"They still have to weigh the prejudice of that type of information and whether it's relevant to this particular circumstance, in this particular case," Lerman said.

First up, said Lerman, look for the defense to ask the judge for a new trial. Dippolito's lawyers have 10 days to do that.

"They will file a motion for a new trial, which will really outline for everybody what the issues are going to be on appeal," said Lerman.

Judges rarely grant a new trial, but such a motion is part of the overall appeal process.

The judge set July 21 for Dippolito's sentencing, and ordered her into custody.

Dippolito faces up to 20 years in prison-- the maximum established by the original sentence she received following her 2011 conviction, which was overturned.

After sentencing, she has 30 days to file her appeal.
